The Assisted Decision-Making (Capacity) Act of 2015 and the Assisted Decision-Making (Capacity) (Amendment) Act 2022
The Decision Support Service is a new service for all adults who have difficulties with their decision-making capacity. The Decision Support Service is a public body established within the Mental Health Commission by the Assisted Decision-Making (Capacity) Act 2015.
Supporting Members to Make Their Own Decisions
The rules around decision-making have changed. Under the Assisted Decision-Making (Capacity) Act 2015 (commenced 2023), all members are supported to make their own financial and personal decisions wherever possible.
- Everyone is assumed to be able to make their own decisions
- Some members may need support, depending on the decision
- Support is provided before anyone else can make decisions for them
- Different types of support are available, from assistance to full representation as a last resort
- The person’s will and preferences must always be respected
- The system is overseen by the Decision Support Service
